Sustainability Claims: What You Can Legally Say

Sustainability copy is now regulated in most major markets, and the enforcement risk sits with the brand and the retailer, not with the mill. The practical rule is that a claim must be specific, substantiated and not misleading in context. Made with recycled yarn is a claim you can support with documents. Sustainable is a claim you probably cannot, because it invites a regulator to ask what you mean by it and you will not have a good answer.

Qualify every environmental claim

Name the attribute and the number: recycled nylon content, expressed as a percentage of garment weight, or post-consumer content, stated separately from post-industrial. State what the claim covers, because a bra with a recycled shell and a conventional elastic and pad is not a recycled garment. If only part of the product qualifies, say which part. Qualified claims convert nearly as well as broad ones and do not create liability.

Hold documentation per lot, not per style

A mill certificate produced at sampling does not cover production six months later. For recycled content claims, require a transaction certificate that references the specific production lot, and keep it in the shipment file alongside the test reports. The same logic applies to any chemical restriction claim: the evidence has to correspond to the goods you actually received, and it has to be retrievable when someone asks.

Avoid the blanket terms

Eco-friendly, green, sustainable, planet-friendly and clean are the terms most likely to be challenged, because they assert an overall environmental benefit that a single attribute cannot support. Replace them with the specific fact behind them. If you cannot name a fact, do not make the claim. This also applies to imagery and color: leaf motifs and earth tones on packaging function as claims in several jurisdictions.

Care and end-of-life claims need care

Claims about longevity, biodegradability or recyclability are the highest-risk category, because they depend on conditions outside your control. A garment is only recyclable where infrastructure exists to process it, and a biodegradable claim is meaningless for a product designed to be washed a hundred times. If you want to communicate durability, do it with a test result you hold, such as retained stretch recovery after a defined number of wash cycles, and state the test conditions.

Write the copy with the evidence in front of you

Have the marketing team write from the documentation pack rather than from a brief. Each claim should trace to a file in that pack: composition statement, transaction certificate, test report, or a supplier declaration with a named signatory. If a sentence cannot be traced, cut it. Copy that survives review is not weaker marketing; it is the only kind you can keep on the page after someone asks for proof.
