CPSIA, REACH and OEKO-TEX Requirements for Activewear

Compliance paperwork is where many activewear programmes quietly fail. The garment is fine, the testing was done, but nobody can produce the right certificate for the right lot when a retailer, a marketplace or a customs authority asks. Three frameworks cover most of what a sports bra buyer will encounter: CPSIA in the United States, REACH in the European Union, and OEKO-TEX as a voluntary commercial standard that many retailers treat as mandatory. They overlap but are not interchangeable.

CPSIA: Scope Depends on the End User

The Consumer Product Safety Improvement Act applies in full only to children products, defined as goods designed or intended primarily for children 12 years or younger. If a sports bra range includes girls sizes, the obligations are substantial: lead content limits of 100 ppm in substrates, phthalate restrictions, permanent tracking labels on both the product and the packaging, third-party testing by a CPSC-accepted laboratory, and a Children Product Certificate supported by test reports. Adult activewear is not covered by those provisions, but all wearing apparel remains subject to the flammability rules at 16 CFR 1610, under which normal fabrics are Class 1, and children sleepwear has separate rules at 16 CFR 1615 and 1616. Decide at the design stage whether a size run is a children product; retrofitting compliance after production is expensive.

REACH: The Substance Rules

EU Regulation (EC) 1907/2006 applies to all articles placed on the EU market. The obligations that matter for textiles sit in Annex XVII. Azo dyes that cleave to any of 22 listed aromatic amines are restricted to 30 mg per kg under entry 43, tested by EN 14362-1 for fibers and EN 14362-3 where 4-aminoazobenzene may be present. Nonylphenol ethoxylates are restricted to 0.01 percent by weight under entry 46a. Nickel release from skin-contact metal parts is limited under entry 27. Polycyclic aromatic hydrocarbons and certain CMR substances in textiles are also restricted. Separately, if any substance on the SVHC candidate list is present above 0.1 percent weight by weight in an article, the supplier has communication obligations. In practice, buyers handle this by issuing a restricted substances list and requiring a signed declaration plus test reports against it.

OEKO-TEX: A Commercial Standard That Does Real Work

OEKO-TEX Standard 100 is not a law, but it is accepted by most major retailers and marketplaces as evidence of chemical safety. It tests for a broad panel including formaldehyde, heavy metals, pesticides, chlorinated phenols, phthalates, PFAS and colorants, with limits set by product class: class I for baby articles, class II for articles with direct skin contact, and classes III and IV for less intimate contact. A medium impact sports bra is class II. Certificates are valid for one year and cover defined articles, not a company in general, so check that the style and component list on the certificate actually matches what you are buying. What to Request Per Shipment

Ask for, in writing and per lot: a valid OEKO-TEX certificate with the correct scope and expiry date; a REACH restricted substances declaration signed by the supplier; third-party test reports for azo dyes, nickel release if hardware is present, formaldehyde, and phthalates where applicable; a CPSIA Children Product Certificate and third-party test reports for any children sizes; and a declaration of fiber content by lot. Verify that report dates fall within the certificate validity period and that the article descriptions match. A certificate for generic knitted fabric does not cover a finished bra with hardware, foam pads and a printed logo.

Keep the File Audit-Ready

Store the document set by purchase order and lot number for at least five years, and longer where EU market surveillance practice expects it. Marketplaces and retailers increasingly request this documentation before listing rather than after a complaint, and the ability to produce it in a day is a commercial advantage worth more than the testing cost.
